Terms of Service for Recruitment Agency
These Terms of Service ("Terms") govern the use of the services provided by Fox Morris Group Ltd ("Agency"), a recruitment agency, to its clients ("Clients" or "Employers") and candidates ("Candidates" or "Job Seekers"). By using the services of the Agency, Clients and Candidates agree to be bound by these Terms.
1.Services Provided
1.1 Client Services: The Agency will provide recruitment services to Clients, including but not limited to sourcing, screening, and presenting suitable Candidates for employment opportunities. The Agency will strive to match the skills, qualifications, and experience of Candidates with the requirements provided by Clients.
1.2 Candidate Services: The Agency will assist Candidates in their job search by providing access to employment opportunities, facilitating the application process, and offering career advice and guidance.
2.Confidentiality
2.1 Client Confidentiality: The Agency will treat all information shared by Clients, including job requirements, company details, and any other sensitive information, with the utmost confidentiality. The Agency will not disclose such information to any third parties without the express consent of the Client.
2.2 Candidate Confidentiality: The Agency will treat all information provided by Candidates, including personal and professional details, resumes, and employment preferences, as confidential. The Agency will not disclose such information to any third parties without the express consent of the Candidate.
3.Fees and Payments
3.1 Client Fees: Clients agree to pay the Agency a fee for the recruitment services provided. The fee structure, including the amount and payment terms, will be agreed upon between the Agency and the Client prior to commencing the recruitment process.
4. Liability and Disclaimer
4.1 Client Liability: The Agency will exercise reasonable care and diligence in providing its services to Clients. However, the Agency does not guarantee the suitability, qualifications, or performance of any Candidate referred to the Client. The Agency shall not be liable for any damages, losses, or claims arising from the employment or engagement of a Candidate by the Client.
4.2 Candidate Liability: The Agency will strive to present Candidates with legitimate and suitable employment opportunities. However, the Agency does not guarantee the availability of any job or the suitability of any employment opportunity for a Candidate. The Agency shall not be liable for any damages, losses, or claims arising from a Candidate's engagement or employment with a Client.
5.Termination
5.1 Client Termination: Clients may terminate their engagement with the Agency by providing written notice. The Agency may terminate its services to a Client if there is a breach of these Terms or if the Agency determines, in its sole discretion, that the relationship is no longer viable.
5.2 Candidate Termination: Candidates may discontinue their use of the Agency's services at any time without providing notice. The Agency may terminate its services to a Candidate if there is a breach of these Terms or if the Agency determines, in its sole discretion, that the relationship is no longer viable.
6.Intellectual Property
6.1 Agency Ownership: The Agency retains all intellectual property rights to its website, software, databases, and any other materials used to provide its services. Clients and Candidates may not reproduce, modify, or distribute any of these materials without the Agency's prior written consent.
7.Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of United Kingdom. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of United Kingdom.
